SUBJECT:

Agreement for Right of Way and Power Services,
North Peak Radio Station (Lease No. 1016)

 

Recommendation
Adopt a Resolution authorizing the President of the Board of Supervisors to execute an Agreement with ATC Holding, Inc. for use of their road and electrical power from the Coast Highway (Route 1) to the North Peak Radio Station, Montara Mountain.

 

Background
Since 1963, the County has maintained a radio repeater facility on North Peak above Montara. Also since that time, the County has had an Agreement for the use of the access road to the site and the power line. The Agreement with North Peak Trust expired on June 30, 1998. Since this time the County has had use of the road and power line on a month to month basis while a new agreement was negotiated with the current owner, ATC Holding, Inc.

 

Discussion
A proposed agreement has been negotiated and is summarized as follows:

1.

The term of the agreement shall be for five (5) years beginning August 1, 2001 and expiring on July 31, 2006.

2.

ATC Holding, Inc. will maintain the road and provide electrical service to the County from their privately owned electrical line leading from PG&E facilities to the vicinity of Highway 1.

3.

The County will contribute a not to exceed amount of $5,000 towards required road repairs, $19,693.80 towards replacement of the power poles and $5,000 towards an electrical grade upgrade.

4.

The monthly fee shall remain unchanged at $600 per month with annual increases of four (4) percent. This is considered a fair market fee for this use.

5.

Either party shall have the option to terminate this agreement with at least one hundred and twenty (120) days in advance notice.

The agreement has been reviewed and approved by County Counsel. The Chief Information Officer concurs with our recommendation

Fiscal Impact
Funds for the monthly fee have been budgeted in the Information Services Department's rental budget
