RECOMMENDATION

 

That the Board of Supervisors:

 

1.

Find that the request is consistent with the County General Plan, the Resource Management Zoning District, the California Land Conservation Act, and the Board of Supervisors Resolution No. 28375, relating to the implementation of the California Land Conservation Act in San Mateo County.

   

2.

Adopt a resolution to rescind the existing agricultural preserve contract and simultaneously approve and authorize execution of a new agricultural preserve contract to reflect a change in legal descriptions regarding the subject property.

   

PROPOSAL

 

Earlier this year, the Board of Supervisors approved a minor subdivision of the applicants' 77.6-acre parcel in the Resource Management District with a condition that the applicants revise their Class A Agricultural Preserve contract to include the new legal descriptions. This requires rescission of the old contract and entering a new contract with the changed legal descriptions.

Setting: The project site is located within the Alpine Creek watershed approximately two miles east of the town of La Honda. Alpine Road runs through a corner of the project site with most of the property being located on the north side of Alpine Road. Less than two acres of the property is located on the south side of Alpine Road. The site consists of moderate and steeply sloping meadows and nearly 80 percent of the property is in open space. The surrounding area is rural in character with low density residential development.

Board of Supervisors approved a Minor Subdivision of the 77.6-acre parcel into two parcels consisting of 39.3 acres and 38.3 acres. A condition of this approval was updating existing Williamson Act contract with the new legal descriptions.

 

DISCUSSION

 

A Class A agricultural preserve contract was established for the subject property on February 15, 1977, and has been automatically renewed until present day. On January 9, 2001, the Board of Supervisors approved a Minor Subdivision of this 77.6-acre parcel into two parcels consisting of 39.3 acres and 38.3 acres. One of the conditions of approval required an update of the Class A agricultural preserve contract (Williamson Act contract) to include new legal descriptions resulting from the minor subdivision. This is a house keeping measure to keep the County's Williamson Act Contracts updated with land use development associated with these contracts.
