RESOLUTION AUTHORIZING ACTIVE MEMBERS TO TRANSFER TO RETIREMENT PLAN 2 ALL COUNTY SERVICE RENDERED UNDER RETIREMENT PLAN 3

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on December 8, 1992, pursuant to the authority contained in Government Code section 31498.3, this Board passed Resolution No. 56757 permitting general members with five years continuous service in Plan 3 to transfer to Plan 2; and

WHEREAS, on September 9, 1997, this Board amended Resolution No. 56757 to allow employees hired on or after July 13, 1997, the option to transfer from Plan 3 to Plan 2, or to the modified Plan 2 as described in San Mateo County Ordinance Code section 2.168.070; and

WHEREAS, section 31498.3(d) further provides that this Board may, by resolution, permit members to transfer to Retirement Plan 2 or modified Plan 2 all County service rendered under Retirement Plan 3 provided that the member deposits into the retirement fund within a specified time an amount equal to the contributions he or she would have made during that time, had he or she been a member of Retirement Plan 2 or modified Plan 2, together with regular interest on that amount; and

WHEREAS, section 31498.3(d) further provides that this Board may establish any other conditions it deems necessary and desirable, and this Board desires that the employee also deposit into the retirement fund within a specified time an amount equal to the contribution the County would have made on the member's behalf during that time had he or she been a member of Retirement Plan 2 or modified Plan 2 and an amount equal to the share of the contributions the County would have made during that time had the employee been a member of Retirement Plan 2 or modified Plan 2 , together the interest thereon; and

WHEREAS, this Board has determined that active general members who convert from Plan 3 to Plan 2 or modified Plan 2 should be able to purchase their service time in Plan 3 in accordance with section 31498.3;

NOW, THEREFORE, IT IS HEREBY DETERMINED AND RESOLVED that active members who have transferred from Plan 3 to Plan 2 or modified Plan 2 may transfer to Retirement Plan 2 or modified Plan 2 all County service rendered under Retirement Plan 3 provided that the active member deposits into the retirement fund prior to retirement an amount equal to the full cost, including interest thereon, of the employee and county contributions, including contributions that the County would have made on the member's behalf during that time had he or she been a member of Retirement Plan or modified Plan 2 (as described in San Mateo County Ordinance Code section 2.168.070).
