BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING EXECUTION OF PURCHASE AND SALE AGREEMENT AND EXECUTION OF A GRANT DEED

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County of San Mateo is the owner of certain real property described in the attached Exhibit "A"; and;

 

WHEREAS, said real property is not required for County purposes and it appears to be in the best interest of County to sell said real property; and

 

WHEREAS, Section 960 of the Streets & Highway Code of the State of California provides that whenever the County Board of Supervisors determines that real property acquired for highway purposes is no longer necessary for those purposes, the County may sell the said real property in the manner and upon the terms and conditions approved by the Board of Supervisors; and

 

WHEREAS, the real property described in Exhibit "A" is not needed for highway purposes; and

 

WHEREAS, the Board of Supervisors on May 2, 2001 executed a Lease Agreement with the Coastside Infant/Toddler Center which contained an option to purchase the real property described on Exhibit A; and

 

WHEREAS, the Coastside Infant/Toddler Center has exercised the option to purchase said real property and has executed a purchase and sale agreement setting forth the terms and conditions of the sale; and

 

WHEREAS, this Board has been presented with said purchase and sale agreement and said Board has examined and approved same as to both form and content and desires to enter into same:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

1.

Said real property is not needed for County highway purposes;

2.

The President of the Board is authorized and directed to (a) execute said purchase and sale agreement and (b) a grant deed to Coastside Infant/Toddler Center, a California corporation to the real property described on Exhibit A attached hereto and made a part hereof and the signature of the Clerk of this Board shall attest thereto.

3.

The Assistant County Manager is authorized to execute all other documents necessary to complete said sale.
