RESOLUTION CREATING THE COLMA CREEK ADVISORY COMMITTEE, SPECIFYING THE RESPONSIBILITIES AND MEMBERSHIP THEREOF, AND STANDING RULES FOR ITS GOVERNANCE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the San Mateo County Flood Control District Act (Uncodified Acts of 1959, Act 7261) created the San Mateo County Flood Control District, designated the board of supervisors as the board of supervisors of the district, and authorizes the board to establish flood zones; and

 

WHEREAS, the board has designated Colma Creek as a flood zone; and

 

WHEREAS, §14 of the San Mateo County Flood Control District Act provides that whenever the board establishes any flood zone it may appoint an advisory committee to represent before the board the residents and property owners of the zone; and

 

WHEREAS, § 14 of the San Mateo County Flood Control District Act specifies the requirements for membership of the advisory committee; and

 

WHEREAS, for many years, there has been a functioning Colma Creek Advisory Committee, although it appears that committee was never formally created by this board; and

 

WHEREAS, this Board of Supervisors now wishes to adopt this resolution to create the Colma Creek Advisory Committee.

 

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

   

1.

There is hereby created the Colma Creek Advisory Committee, to perform the advisory functions set forth herein and in the San Mateo County Flood Control District Act.

   

2.

Members of the Advisory Committee shall serve terms of four years, which shall begin and end on Apr. 1. Upon the conclusion of a term, a member may be reappointed subject to a maximum of twelve years of full terms. Initially, lots shall be drawn so that terms will be staggered into two, three and four year terms.

   

3.

The membership shall consist of a total of nine voting members, consisting or five city representatives and four "at large" members. All nine members must be property owners residing within the zone.

   

4.

The city councils of each of the five cities which have all or part of their incorporated territory within the zone, i.e., Colma, Daly City, South San Francisco, San Bruno and Pacifica, shall appoint one member. The city council appointees must reside within the city they represent.

   

5.

The remaining four members are "at large" members. shall be appointed by the Board of Supervisors.

   

6.

The Advisory Committee will comply with all standing rules for county boards, commissions and advisory committees that are established by the Board of Supervisors.

 

7.

The Advisory Committee shall be staffed by the Department of Public Works.
