RESOLUTION AUTHORIZING THE PURCHASE OF REAL PROPERTY IN UNINCORPORATED EL GRANADA FROM MICHAEL D. McCRACKEN, ET AL AND ANTHONY H. EREDIA TRUST, ET AL

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on August 21, 2001, this Board adopted Resolution 64691 authorizing and directing the President of the Board to enter an Agreement For Exclusive Rights To Negotiate And Purchase Certain Real Property Located In Unincorporated El Granada In The County Of San Mateo, which property is identified as San Mateo County Assessor's Parcels 047-330-010 and 047-331-010, commonly known as the Mirada Surf Property, and more particularly described in the attached Exhibit A which is made a part hereof by reference (the "Property"), and;

WHEREAS, the Clerk of this Board has published once a week for three successive weeks in the San Mateo Times, a newspaper of general circulation published in the County of San Mateo, in the form and manner provided by law, a Notice of Intention to purchase the Property, and it appears from the affidavit of publication on file with the Clerk of this Board that the Notice of Intention has been published in the required manner, and;

WHEREAS, an Agreement For Transfer Of Real Property providing therefor, pursuant to the terms and conditions therein stated, has been presented to this Board of Supervisors, and;

WHEREAS, this Board has read and considered the same and has determined that it is necessary and desirable that the same be executed for and on behalf of the County of San Mateo.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

That the President of this Board of Supervisors be, and is hereby, authorized and directed to execute the aforementioned Agreement For The Transfer Of Real Property and accompanying Certificate of Acceptance for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

 

2.

That the purchase price in the total amount of $6,000,000.00 is approved.

 

3.

That it is hereby authorized and directed that all escrow and title fees shall be paid in accordance with the Agreement.

 

4.

That the Assistant County Manager is hereby authorized to accept or execute on behalf of the County, any and all written notices and documents in connection with the Agreement; and;

 

5.

That the Assistant County Manager is hereby authorized to accept or execute for and on behalf of the County, in a form approved by County Counsel, such agreements as are necessary to complete the purchase as set forth in the Agreement.
