Resolution Adopting Substitution of Trustee and Deed of Reconveyance of Deed of Trust Securing Landscaping Condition on Coastal Development Permit 85-65 (19509 Cabrillo Highway (Koch))

Recommendation

Adopt a resolution approving the Substitution of Trustee and Deed of Reconveyance of a deed of trust securing a landscaping condition on CDP 85-65, 19509 Cabrillo Highway, owned by Klaus Koch.

 

Background

In January 1992, the Board of Supervisors held a hearing to consider the revocation of CDP 85-65, issued to Klaus and Ilse Koch for construction of a single family residence at 19509 Cabrillo Highway in the south coast. Revocation proceedings were begun because the house, located west of Highway One, was determined to have violated a condition requiring that the house be adequately screened from Highway One. In lieu of revoking the permit, the Board required that an agreement requiring installation and maintenance of landscaping be executed and recorded on the property and that a promissory note and deed of trust be provided, in the amount of $32,825, to secure installation of the landscaping. The agreement provided that, once landscaping had been installed and established according to the landscaping plan, the deed of trust would be reconveyed.

 

The resolution before the Board would allow reconveyance of the deed of trust in accordance with the recorded agreement. The original recorded agreement, requiring continued maintenance of the landscaping, will remain in effect.

 

Fiscal Impact

This action will have no fiscal impact on the County.
