BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION BY THE BOARD OF SUPERVISORS AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE STATE OF CALIFORNIA FOR JUVENILE DETENTION FACILITY CONSTRUCTION GRANT FUNDS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the State of California has Federal Violent Crime Control and Law Enforcement Act funds available for the construction of juvenile detention facilities, and this Board wishes to authorize application therefore; and

WHEREAS, it is required that the Board appoints a County Construction Administrator, a Project Financial Officer, and a Project Contact Person to act on the County's behalf in connection with this project; and

WHEREAS, it is required that the Board authorize a representative to sign the Nondiscrimination Compliance and Drug-Free Workplace assurance statements; and

WHEREAS, the Board assures that the County will adhere to state and federal requirements and terms of contract in expenditure of grant and match funds; and

WHEREAS, the Board assures that the County will appropriate, after grant award but before contract, the amount of matching funds identified by the County on the funding application form submitted to the Board of Corrections, and assures that grant and cash funds do not supplant funds otherwise dedicated or appropriated for construction activities; and

WHEREAS, the Board assures that the County will fully and safely staff and operate the Juvenile Detention Facility constructed (consistent with Title 15, California Code of Regulation) with grant and match funds within 90 days after project completion; and

WHEREAS, the Board attests that the Juvenile Hall Detention Facility will be constructed on a site which is County land owned prior to July 1, 2001, and the County has rights of access sufficient to assure undisturbed use and possession of the site and will not dispose of, modify the use of, or change the terms of the real property title, or other interest in the site of facility subject to construction, or lease the facility for operation by other entities, without the permission and instructions from the state Board of Corrections and the Office of Justice Programs, U.S. Department of Justice; and

WHEREAS, the County Real Property Services Division estimates that the fair market value of the proposed construction site, approximately twenty-one (21) acres adjacent to 21 Tower Road, San Mateo, is $25,000,000;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED That the Board adopts the attestations and assurances stated above, and authorizes the San Mateo County Probation Department to submit the County's application for Juvenile Detention Facility Construction Funding to the Board of Corrections. Further, the Board designates and appoints the San Mateo County Manager's Office as the County Construction Manager, Project Financial Officer, and Project Contact Person, and authorizes the San Mateo County Manager's Office to sign the Nondiscrimination Compliance and Drug-Free Workplace assurance statements.
