Permit Agreement with Montara Sanitary District, Inc. for a Public Safety Communication Site, (Lease No. 1249)

 

Recommendation
Adopt a Resolution authorizing the President of the Board of Supervisors to execute a Communication Site Permit Agreement with Montara Sanitary District for the operation of a Public Safety Communication Facility.

 

Background
The Emergency Services Counsel Joint Powers Authority (ESA/JPA) has 21 members representing the County one from in each city in the County. In 1973 the JPA established a radio microwave system to support rapid and coordinated communications between all Public Safety agencies in the County.

In 1998 the ESA/JPA authorized and funded replacement of the system with a new, more comprehensive and expansive system. The new system includes a number of new microwave and radio broadcast sites as part of the improved design of the replacement system. One of the new sites is located on property owned by Montara Sanitary District and located in Montara. A permit agreement has been negotiated for the establishment of a public safety communication facility on property owned by the Montara Sanitary District. In consideration of the use of the Montara Sanitary District's property the County of San Mateo will authorize the District non-exclusive of use adjacent county-owned road surplus property for parking, storage, landscaping and other lawful uses.

 

Discussion
The negotiated agreement presented for your consideration is summarized as follows: The term is for ten (10) years commencing upon execution of the agreement by your Board. Each party has a one-time option to extend the term for an additional period of ten (10) years.

The premises to be used by the County includes approximately 160 square feet of a garage structure, approximately 100 square feet of land where the tower is located together with access and space needed to connect the communication equipment.

In consideration, the County will allow the District non-exclusive use of an adjoining 1.62 acre County parcel.

3.

The County will provide and pay for electrical power for the communication shelter.

4.

There is a mutual hold harmless provision in the agreement.

 

County Counsel has reviewed and approved the agreement and resolution.

 

Vision Alignment
The lease agreement keeps the commitment of responsive, effective and collaborative government and goal number 22: County and local governments effectively communicate, collaborate and develop strategic approaches to issues affecting the entire County. The agreement contributes to this commitment and goal since it establishes a working agreement with benefits to both the County of San Mateo and Montara Sanitary District while furthering public safety.

 

Fiscal Impact
In January 1999 the JPA approved funding for the project with each individual agency formally committing to their share at the JPA 1999 meeting. The Montara site is included in the overall project costs.
