First Amendments to the Fee-For-Service Agreements for Drug Court and/or SACPA/Proposition 36 Alcohol and Drug Treatment Services.

 

Recommendation

Adopt a resolution authorizing execution of first amendments to twelve fee-for-service agreements to amend fingerprinting language, and to add SB 223 drug testing services and funding for the period October 11, 2001 through June 30, 2002.

 

Background

On August 7, 2001 the Board adopted a resolution authorizing the execution of thirteen fee-for-service agreements with various agencies; and authorizing the Director of the Human Services Agency to execute amendments and minor modifications up to $25,000 per funding source. Under these agreements the agencies provide alcohol and drug treatment services funded by state and federal drug court grants and/or Substance Abuse Crime Prevention Act (SACPA)/Proposition 36. These agreements were approved with the understanding that the fingerprinting language be amended to allow service providers options for hiring staff prior to obtaining fingerprinting results.

 

Discussion

On October 11, 2001 SB 223 was signed into law which appropriated funds to administer and award funds to counties for the costs of substance abuse testing under SACPA. To be eligible for these funds, counties must submit a revised County SACPA plan to the State. Our County's revised SACPA plan was submitted t the State on January 10, 2002. San Mateo County's SB 223 allocation for the period October 11, 2001 through June 30, 2002 is $155,379. Of this amount, $6,200 is incorporated into Memorandums of Understanding with Health Services for drug testing for SACPA probationers and parolees in the Pre-to-Three and Methadone programs. The balance of $149,179 is allocated in aggregate in these first amendments. Services are reimbursed on a fee-for-service basis.

 

These first amendments to the fee-for-service agreements amends the fingerprinting language in the body of the agreement, as requested by the Board of Supervisors at their August 7, 2001 Board meeting. These amendments also add SB 223 drug testing funds and services to the Agreements containing SACPA/Proposition 36 alcohol and drug treatment services.

 

One of the original thirteen fee-for-service agreements, New Leaf, is in the process of being terminated per the Contractor's request.

 

This resolution and twelve first amendments have been reviewed and approved by County Counsel as to form. The original agreements contained the Equal Benefits Ordinance compliance requirement.

 

Fiscal Impact

These first amendments include an aggregate total of $149,179 in SB 223 drug testing funds, and drug testing services for individuals participating in SACPA/Proposition 36 services. Funds are allocated in these twelve agreements on a fee-for-service basis. There are no Net County Costs associated with these first amendments.
