RESOLUTION AUTHORIZING EXECUTION OF

AMENDED AGREEMENT BETWEEN COUNTY OF SAN MATEO AND EAST PALO ALTO COMMUNITY ALLIANCE & NEIGHBORHOOD DEVELOPMENT ORGANIZATION (EPA CAN DO) TO ASSIST WITH THE DEVELOPMENT OF AFFORDABLE RENTAL HOUSING

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, County and EPA CAN DO entered into an Agreement dated June 6, 2000, Board of Supervisors Resolution No. 63659, amended November 14, 2000 by Board of Supervisors Resolution No. 64087, which provided $883,137 to assist with the development of 20 units of rental housing in East Palo Alto; and

 

WHEREAS, EPA CAN DO has redesigned the development to increase the number of units to approximately 32; and

 

WHEREAS, in support of the expansion of the project, EPA CAN DO has been awarded an additional $195,000 of FY 01/02 HOME funds, a pre-commitment of $300,000 of FY 02/03 HOME funds, and $350,000 of FY 01/02 CDBG funds; and

 

WHEREAS, County and Contractor desire to further amend said Agreement to, among other things, reflect the increase scope of funding and development; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an agreement between the County of San Mateo and East Palo Alto Community Alliance & Neighborhood Development Organization, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same;

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and the President is hereby authorized and directed to execute said agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

 

IT IS FURTHER RESOLVED, that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and modifications to this Agreement during the term of the Agreement, provided however, that such authority is limited to (a ) reducing or increasing the County's maximum fiscal obligation in the event that there is a commensurate reduction or increase in the funding received by the County, provided, however, that such increases shall be limited to a total of $25,000 per funding source; and (b) making changes in the types of services and activities provided by Contractor, provided that the changes have no impact on the County's maximum fiscal obligation to the Contractor.
