RESOLUTION WAIVING THE REQUEST FOR PROPOSALS PROCESS, WAIVING THE EQUAL BENEFITS REQUIREMENTS, AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH SYNOVATION INCORPORATED, AND AUTHORIZING THE CHIEF PROBATION OFFICER TO EXECUTE AMENDMENTS TO THE AGREEMENT IN THE AGGREGATE AMOUNT OF $25,000 DURING ANY FISCAL YEAR

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Ordinance Code section 2.92.160 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board of Supervisors determines that the best interest of the county could be served without the necessity of proposals in that pursuant to Administrative Memoranda promulgated by the County Manager, San Mateo County's Administrative Memorandum B-1, dated August 19, 1999, allows for the results of another public agency's competitive process to be used; and

WHEREAS, San Diego County selected Synovation Incorporated as a result of a Request for Proposals process in August 2000; and

WHEREAS, Synovation Incorporated will meet the same basic terms and conditions as in San Diego County's agreement; and

WHEREAS, Synovation Incorporated is the only commercially available browser-based Probation Case Management System that is installed in a California county and is the only system that has the ability to electronically report mandated statistics to the California Department of Justice (DOJ) and the Board of Corrections (BOC); and

WHEREAS, the Chief Probation Officer, in conjunction with the Information Services Department has asked the Board to waive the Request for Proposals requirements and the Equal Benefits requirements for the acquisition and implementation of a web-based juvenile probation case management system; and

WHEREAS, it is in the best interests of the County to waive the requirement that the Contractor provide equal benefits to its employees as required by the County Ordinance Code; and

WHEREAS, the Board of Supervisors has been presented with a form of the Agreement and desires to enter into the Agreement:

NOW THEREFORE, IT IS RESOLVED that the Request for Proposals process is waived, the requirement for provision of equal benefits as required by the San Mateo County Ordinance Code is waived, and the President of this Board of Supervisors is hereby authorized and directed to execute said Agreement for an on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto;

BE IT FURTHER RESOLVED, that the Chief Probation Officer is hereby authorized to execute subsequent Amendments to the Agreement with Synovation Incorporated not to exceed the aggregate of $25,000
