Recommendation |
Adopt a resolution authorizing the President of the Board to execute a Revocable Encroachment Permit with Citizens Utility of California (Citizens) which allows Citizens and its successors and assigns to operate and maintain water wells at the Half Moon Bay Airport and sets the price of the water extracted from said wells. |

Previous Board Action |
1. |
Approved a Revocable Encroachment Permit on December 12, 1978, which allowed Citizens, a Public Utilities Commission regulated water company, to use Airport property for the pumping of ground water, and set the rate charged for the use of said property. |

Adopted a resolution on July 24, 2001, authorizing the Director of Public Works to increase the rates charged for the use of Half Moon Bay Airport property in conjunction with the pumping of water by Citizens over a three-year period. |

Discussion |
The recommended non-exclusive revocable encroachment permit grants to Citizens and its successors and assigns the right to operate and maintain three (3) existing wells on the Half Moon Bay Airport for the term of ten (10) years with a possible ten-year extension. Citizens will be required to pay the airport enterprise fund for water extracted from these wells at the rates shown below which were established by your Board on July 24, 2001: |

Staff will review these rates between August 1, 2005, and July 31, 2006, and make recommendations to your Board for a rate adjustment prior August 1, 2006. |

Vision Alignment |
We believe our recommendation is consistent with Goal Number 7, "Maintain and Enhance the Public Safety of all Residents and Visitors" of the Shared Vision Commitment to "Ensure Basic Health and Safety for All" as authorizing the encroachment permit provides Citizens with their primary source of potable water which will be used by the residents and visitors in Citizens' service area. |

Fiscal Impact |
The Airport Enterprise Fund will receive an initial fee of $1,000 and we estimate the Fund, based on current water usage, will receive an additional $28,000 in revenues this year increasing to $70,000 per year in 2004 for water extracted from the airport wells. |

There is no impact to the General Fund. |

A form of resolution and encroachment permit has been approved by County Counsel and Citizens has executed the permit. |
