Recommendation

Establish a Charter Review Committee To Make Recommendations To The Board Of Supervisors Regarding Proposed Amendments To The County Charter.

 

Background

Section 801 of the County Charter requires that the Board of Supervisors shall convene a Charter Review Committee within eight (8) years of the last complete Charter Review. The Committee must review the Charter and, after public hearings, make appropriate recommendations for amendment or revision to the Charter. The last general Charter review was in 1994. Therefore, it is necessary that this year the Board convene a Charter Review Committee.

Discussion

There are two alternative methods available for Charter revisions. First, under Government Code §23701, an elected Charter Review Commission may place charter amendments directly on the ballot. Alternatively, under Government Code §23711, the Board of Supervisors may itself propose charter amendments to be voted for. It is recommended that this latter procedure be utilized and that the Board appoint a citizen's Charter Review Committee to make recommendations to the Board as to any proposed revisions to the Charter.

For the composition of the Charter Review Committee, it is recommended that each supervisor appoint one member and that five additional members be appointed representing significant community organizations. I recommend that these five appointees be:

To place proposed changes on the November 5, 2002 ballot, the Board would have to enact an ordinance by August 9, 2002. The Board could introduce the ordinance at its July 30th meeting and adopt it at its August 6th meeting. Accordingly, the Charter Review Committee's report should be received in late June. If the deadlines for placing the proposed revisions on the November ballot are missed, the next election date would be March 5, 2003.
