Resolution Authorizing Amendment to Agreement with Akin, Gump, Strauss, Hauer & Feld, LLP, for Services in Relation to the Proposed Expansion of San Francisco International Airport and Other Issues Regarding the City and County of San Francisco

 

Recommendation

1.

Adopt a resolution authorizing and directing the President of the Board to execute an amendment to the agreement with the law firm of Akin, Gump, Strauss, Hauer and Feld, LLP, for services in relation to the proposed expansion of the San Francisco International Airport and other issues regarding the City and County of San Francisco, increasing the maximum amount of the agreement to $500,000; and

   

2.

Approve an Appropriation Transfer Request (ATR) transferring $250,000 from General Fund Non-Departmental Reserves to County Counsel's budget to increase appropriations for services related to this amendment.

 

Background

On September 18, 2001, this Board approved and entered into a contract with the law firm of Akin, Gump, Strauss, Hauer & Feld, LLP, a law firm with particular expertise in the area of airport construction and operation, to represent the County in carrying out its responsibilities under the State Aeronautics Act and the California Environmental Quality Act with respect to the proposed San Francisco Airport expansion project, and to further represent the County with respect to other issues involving the County and the City and County of San Francisco. The Board also appropriated $250,000 for that purpose. The maximum amount of the initial contract was $200,000. It has now become evident that, due to the complexity of the issues, and the time and effort that will be necessary to resolve them, the amount of the contract must be increased. A contract amendment to accomplish this has been prepared and is now presented to the Board for its review and approval.

 

Vision Alignment

This action would help the County achieve the Shared Commitment to redesign the County's urban environment to increase vitality, expand variety and reduce congestion, and the Shared Goal of making land use decisions that consider transportation and other infrastructure needs as well as impacts on the environment and on surrounding communities.

 

Fiscal Impact

The contract, as amended, would reimburse Akin, Gump, Strauss, Hauer & Feld, LLP, on a time and materials basis, with a cap of $500,000. It is unknown at this time what the full costs of representation would be since the services to be provided will depend on future events. The contract includes a termination clause allowing the Board to terminate the contract upon thirty days notice. An additional appropriation of $250,000 will be transferred from General Fund Non-Departmental Reserves to County Counsel's budget for payment of these services.
