RESOLUTION AUTHORIZING THE EXECUTION OF THE CORRECT VERSION OF AGREEMENT FOR THE ACQUISITION OF THE MIRADA SURF PROPERTY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on January 15, 2002, this Board adopted Resolution 65021 authorizing and directing the President of the Board to execute the Agreement For The Transfer of Real Property, pursuant to which the County of San Mateo was to purchase the Mirada Surf property; and

WHEREAS, the terms and conditions of said agreement have been fulfilled in connection with the County's purchase of the Eastern Portion of the Mirada Surf property, which purchase closed on January 31, 2002; and

WHEREAS, it has recently been discovered that the version of the agreement actually executed by the President of the Board was not the correct version of the agreement as executed by the Owners and contemplated by the Board; and

WHEREAS, the general terms of the correct version of the Agreement For Transfer Of Real Property has been presented to this Board of Supervisors; and

WHEREAS, to avoid arguments, or claims of inconsistency or error, it is in the best interests of all parties that the correct version of the agreement be executed by the County and used as the final enforceable agreement for all purposes.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

1. That the President of this Board of Supervisors be, and is hereby, authorized and directed to execute the correct version of the Agreement For The Transfer of Real Property in connection with the acquisition of the Mirada Surf property and to substitute said version, for all purposes, for any earlier version that may have been executed.
