Amendment to Agreement with the San Mateo County Transportation Authority Regarding Real Estate Support Services |

Recommendation |
Adopt a resolution authorizing and directing the President of the Board to execute Amendment No. 1 to the Agreement between the County of San Mateo and the San Mateo County Transportation Authority regarding real estate support services. |

Background |
On September 28, 1999, the County and the Transportation Authority entered into an agreement through which the County provided support services to the Transportation Authority for the acquisition of real property by the Authority. Such services were required because (1) SamTrans staff, on behalf of the Transportation Authority, had not received certification from Caltrans to perform right-of-way appraisal, acquisition and relocation services, and (2) the Transportation Authority does not possess the statutory power of eminent domain. |

SamTrans staff has now been certified by Caltrans to conduct the necessary real estate services. An amendment to the agreement has been prepared that would recognize that SamTrans would assume lead responsibility for real estate related services applicable to the Transportation Authority, with the ability to call on the County to supplement that effort as needed. The amendment would leave intact the County's role in assisting in condemnation proceedings. |

Fiscal Impact |
None. Any staff time spent by County staff would be reimbursed. |
