AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN

THE COUNTY OF SAN MATEO AND THE CALIFORNIA NURSES ASSOCIATION

1. The current Memorandum of Understanding (MOU) between the County and CNA (January 9, 2000 - March 29, 2003) is extended so that the MOU expiration date will be March 27, 2004.

2. Section 8.1 (Salaries) and Exhibit A of the MOU are amended to provide that effective on the next pay period following adoption of this Letter of Understanding by the Board of Supervisors, the salary ranges for all nurses in the representation unit will be increased by six percent (6%).

3. Section 8.1 (Salaries) and Exhibit A of the MOU are further amended to provide that effective March 30, 2003, the salary ranges for all nurses in the representation unit will be increased by four percent (4%).

4. In the event that modifications are made during MOU negotiations with AFSCME Local 829 regarding any of the provisions contained in Section 24 - Hospitalization and Medical Care, Section 25 - Dental Care, or Section 26 - Vision Care, that become effective before the new CNA MOU expiration date of March 27, 2004, such modifications to Sections 24, 25 and/or 26 will be implemented in the CNA MOU effective upon implementation with AFSCME Local 829.

5. Between January 1, 2003 and February 1, 2003, either the County or CNA may notify the other party of an interest in meeting and conferring on up to two (2) proposals on provisions of the MOU. Upon receipt of such request the parties will meet and confer regarding up to two (2) proposals from each party. In the event that an agreement is achieved during these discussions, the MOU will be modified accordingly. In the event that no agreement is achieved on any specific proposal introduced by either party, the relevant MOU section will remain in effect as currently written until the expiration date of March 27, 2004. For the purposes of this limited MOU re-opener, the following sections of the MOU are excluded from being introduced by either party for consideration in the meet and confer process, except by mutual agreement by both parties: Section 8 - Salaries, Section 12 - Differential, Section 13 - Application of Differential, Section 24 - Hospitalization and Medical Care, Section 25 - Dental Care, and Section 26 - Vision Care. Any sections of the MOU not proposed for modification by either party during this limited re-opener will remain in full force and effect until the expiration of the MOU on March 27, 2004.
