TO:

Honorable Board of Supervisors

FROM:

Paul T. Scannell, Assistant County Manager

SUBJECT:

Permit Agreement with Verizon Wireless Messaging Services for the Installation, Operation and Maintenance of Paging Equipment at the Hall of Justice and Records (Lease No. 5286)

Recommendation

Adopt a resolution authorizing the President of the Board of Supervisors to execute a Permit Agreement with Verizon Wireless Messaging Services for the installation, operation and maintenance of paging equipment at the Hall of Justice and Records.

Background

The County's Public Safety Communications (911) is located in the basement of the Hall of Justice and Records. Verizon Wireless is currently providing paging services to the Division. In consideration of Verizon providing this service, the County will provide the space, electrical power and telephone access necessary to operate the paging equipment at no charge to Verizon Wireless.

Discussion

A permit agreement has been negotiated and is summarized as follows:

1. The term commences upon the date Permittee begins installing its transmitting station and will run until terminated by either party.

2. Permittee agrees that its equipment will not cause any interference to Permittor.

3. Either party may, with 120 days notice, terminate this Permit at anytime.

4. The Permittee will hold the County harmless and is required to maintain Workers'

Compensation and liability insurance under the agreement.

County Counsel has reviewed and approved the agreement. The Chief Information Officer of the Information Services Department concurs in our recommendation.

Vision Alignment

The permit agreement keeps the commitment of responsive, effective and collaborative government and goal number 22. Government decisions are the result of careful consideration of future impact, rather than temporary relief or immediate gain. The permit agreement contributes to this commitment and goal since it establishes a working agreement with benefits to both the County and Verizon Wireless while furthering public safety.

Fiscal Impact

There is no fiscal impact associated with the Agreement.
