Resolution Adopting Facts and Findings for the Initial Study and Mitigated Negative Declaration for the San Francisquito Creek Levee Restoration and Floodwall Reconstruction Project, and Approving the Mitigation Monitoring and Reporting Plan for the Project

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the Governing Board of the San Mateo County Flood Control District, that:

 

WHEREAS, it is the policy of the State of California and the County of San Mateo, as provided in the provisions of the California Environmental Quality Act of 1970, as amended, and the provisions of Title XIV, California Administrative Code, Guidelines for Implementation of the California Environmental Quality Act of 1970 (hereinafter "CEQA" and "Guidelines," respectively), that the County should not approve a project if it would result in a significant environmental impact if there are alternatives or feasible mitigation measures available which would substantially lessen the significant effects of such projects; and

 

WHEREAS, an Initial Study and Mitigated Negative Declaration, hereinafter IS/MND, analyzing the potential significance of impacts associated with the proposed San Francisquito Creek Levee Restoration and Floodwall Reconstruction Project has been prepared and circulated, pursuant to the requirements of CEQA guidelines and County-adopted objectives and procedures for the evaluation of projects and the preparation of Environmental Impact Reports and Negative Declarations; and

 

WHEREAS, prior to action on the Project, the Board of Supervisors of the County of San Mateo (the "Board"), acting as the Governing Board of the San Mateo County Flood Control District (the "District") must adopt the IS/MND, together with any comments received during the public review process, as being complete, correct and adequate, and prepared in accordance with all applicable State and local guidelines; must consider the IS/MND and the application of all mitigating measures and project alternatives described in the IS/MND; and must find that the IS/MND has considered all environmental impacts of the proposed Project; and

 

WHEREAS, concurrent with the resolution adopting the IS/MND and concurrent with adoption of the findings required under CEQA, Section 21081, the Mitigation Monitoring and Reporting Plan, with any revisions indicated, shall be adopted which identify mitigation monitoring actions and performance standards which are necessary to ensure compliance with the prescribed and adopted mitigation measures and to evaluate their effectiveness in achieving the stated purpose; and

 

WHEREAS, based on review and consideration of the IS/MND, evidence presented in the staff report prepared by County Public Works staff and consideration of testimony presented at the public hearing on the proposed project, there is evidence that the Project as proposed may result in significant impacts; and

 

WHEREAS, pursuant to section 21081.6 of CEQA, a proposed mitigation monitoring and reporting plan has been prepared, which addresses each of the potentially significant environmental impacts, the mitigation measure(s) which address such impact, and a monitoring and reporting program;

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors of the County of San Mateo, acting as the Governing Board of the San Mateo County Flood Control District, finds that mitigation measures have been incorporated in the Project that substantially lessens or avoid the potentially significant impacts of the Project. These mitigation measures, and the impacts they address, are set forth in the Mitigation Monitoring and Reporting Plan for the Project, set forth in Exhibit "A" hereto and incorporated herein by this reference.

 

BE IT FURTER DETERMINED AND ORDERED, that the Board of Supervisors of the County of San Mateo, acting as the Governing Board of the San Mateo County Flood Control District, does hereby approve the Mitigation Monitoring and Reporting Plan for the Project, attached hereto as Exhibit "A".
