Initiation of Condemnation Proceedings for Acquisition of Real Property for State Highway Purposes

 

Recommendation

Adopt a Resolution pursuant to Streets and Highways Code Section 760 authorizing the County to condemn real property or interests therein, as required, for State highway purposes in support of the Highway 101 Ralston Avenue to Marsh Road Widening Project.

 

Previous Board Action

On April 2, 2002, by adoption of Resolution No. 65156, the Board of Supervisors authorized an amendment to an agreement to provide real estate related services for the San Mateo County Transportation Authority (SMCTA). As part of the agreement, as amended, the County Board of Supervisors agreed to adopt a resolution of necessity for property to be acquired for SMCTA projects.

 

Discussion

Streets and Highways Code Section 760 provides that if the board of supervisor of any county determines, by a four fifths vote of its membership, that the acquisition of property authorized under that statute will promote the interest of the county and its acquisition is recommended in writing by Caltrans, the board may acquire property for state highway purposes and take title in either its own name or in the name of the State.

 

The State has asked that the Board of Supervisors acquire property for the Ralston Avenue to Marsh Road Project. The Project will add auxiliary lanes on each side of Route 101 from the Marsh Road Interchange to the Ralston Avenue Interchange to enhance safety, provide operational improvements and alleviate congestion. Additional features of this Project include soundless retaining walls, frontage road modifications and landscaping. This will involve the acquisition of approximately 12 parcels (2 permanent easements and 10 temporary constriction easements).

 

Vision Alignment

We believe that our recommendation is consistent with the Shared Commitment AEnsure Health and Safety for All@ in that the acquisition of the easements will provide for the construction of sound walls to reduce roadway noise for the people living near the highway and Shared Commitment AResponsive, Effective and Collaborative Government@ in that we are working cooperatively with the Transportation Authority to implement the project.

 

Fiscal Impact

The project is being funded by SMCTA. No County funds are included in the project budget. Additionally, the amendment to the aforementioned agreement allows SMCTA staff to conduct all real estate related activities for the Project and allows SMCTA legal staff to file all eminent domain and related actions. Thus, besides a minimum of County Counsel time required to review documentation for Board actions, no staff time will be spent on the project.

 

There is no impact on the General Fund.

 

A form of resolution has been approved by County Counsel.
