FROM:

SUBJECT:

Permit Agreement with MetroPCS for a Communication Facility at the Tower Road Complex, San Mateo (Lease No. 5290)

Recommendation
Adopt a resolution authorizing the President of the Board of Supervisors to execute a Permit Agreement with MetroPCS to install, maintain and operate a wireless communication facility at the County's Tower Road Complex.

Background
Metro PCS has requested the use of a small portion of Tower Road Complex which is located in the unincorporated area adjoining the City of San Mateo. The proposed use is for the installation of a wireless communication site within an area of approximately 150 square feet. The installation will include an equipment shelter with six (6) antennas and one (1) GPS antenna on the County's water tower.

The proposed use has been reviewed and approved by the Planning Department and is subject to the Planning Department's recommended findings and conditions of approval.

Discussion
The term is for five years with a monthly fee of $2,400 with annual rental adjustments based on the Consumer Price Index. In addition the County's Planning Department will receive $1,000 for engineering costs associated with the preparation, engineering and technical analysis to assure compatibility of the site. Either party may terminate the agreement with one hundred and eighty (180) days written notice.

Vision Alignment
The lease agreement keeps the commitment of responsive, effective and collaborative government and goal number 20: Government decisions are based on careful consideration of future impact, rather than temporary relief or immediate gain. The agreement contributes to this commitment and goal since it establishes a working agreement with benefits to both the County of San Mateo and MetroPSC while also benefiting the public.

Fiscal Impact
The rent will be deposited into the Facilities Account in the Department of Public Works.
