No Parking and Tow-Away Zone on Michael D. Nevin Way - Colma Area

 

Recommendation

Adopt an Ordinance establishing a No Parking and Tow-Away Zone on Michael D. Nevin Way (Nevin Way).

 

Previous Board Action

Authorized the construction of a pedestrian promenade on Nevin Way (formerly "B" Street) which provides pedestrian access from El Camino Real to the Colma BART Station, and to the adjacent housing complex.

 

Key Facts

A driveway access was constructed on Nevin Way to allow emergency access vehicles to use Nevin Way to access the back area of the adjacent housing complex that was built by the Housing Authority.

 

We have had complaints that tenants and others have been using the driveway to access and park on Nevin Way.

 

The Colma Fire District has requested that the driveway not be blocked by bollards or other removable obstacles as it will slow their response time to this area.

 

Section 22651(n) of the California Vehicle Code provides that vehicles can be towed if the area is posted as a no parking and tow-away zone.

 

The Broadmoor Police Protection District (Broadmoor Police) has agreed to cite and have vehicles that park on Nevin Way towed if the area is posted.

 

Discussion

Nevin Way was identified in the BART Station Area Specific Plan as a formal, clearly visible pedestrian walkway to BART. We recently completed the construction of Nevin Way which included a driveway access to allow emergency vehicles to access the back of the housing that was constructed concurrent with Nevin Way, and to the housing proposed on the adjacent SamTrans property.

 

The driveway is being used by other than emergency vehicles and we had suggested that bollards be installed to preclude the use of this driveway by non-emergency vehicles. Both the Colma Fire District and the Broadmoor Police requested that the driveway not be blocked as is would reduce their response time for emergency calls in this area.

 

The Broadmoor Police suggested that Nevin Way be posted as both a no parking and tow-away zone and have agreed to cite vehicles that parked in this area and have them towed once the area was posted.

 

Vision Alignment

We believe our recommendation is consistent with Shared Vision Commitment to "redesign our urban environment to increase vitality and reduce congestion," and "ensure basic health and safety for all," as prohibiting parking on Nevin Way will provide the public with an unobstructed pedestrian access to transit while not reducing the response time of the emergency service providers to this area.

 

Fiscal Impact

Installation of no parking/tow-away signs is estimated to cost $1,000 and is proposed to be funded by the Road Fund. There is no impact to the General Fund.

 

A form of Ordinance has been approved by County Counsel.
