AN ORDINANCE AMENDING DIVISION 2, CHAPTER 2.4, ARTICLE 2.4.50, SECTION 2.4.50.090 OF THE SAN MATEO COUNTY ORDINANCE CODE, AUTHORIZING THE SHERIFF OF SAN MATEO COUNTY TO INCREASE THE FEE FOR APPLICANT FINGERPRINTING TO $18 PER PERSON

The Board of Supervisors of the County of San Mateo, State of California, ordains as follows

 

SECTION 1. The Board of Supervisors hereby finds:

 

a)

Pursuant to Penal Code Section 11122, any person desiring a copy of his/her own criminal justice record must complete an application form which includes the taking of fingerprints. Additional various statutes require fingerprinting for various employment and other screening purposes. Pursuant to Penal Code Section 11122, the fingerprinting agency may affix a reasonable fee for the processing of said fingerprints, and retain the fee to offset costs incurred.

 

b)

The CAL-ID RAN Board has recommended, at its meeting of May 2, 2002, that the local fee for applicant fingerprinting services be established at a uniform $18 per person, countywide.

 

c)

The Sheriff's Office applicant fingerprinting fee is currently $12 per person, as established by Ordinance 03882 in November, 1998.

 

d)

The $18 applicant fee reflects the current actual cost of providing fingerprinting services, and would establish consistency with the recommended countywide fee.

 

e)

This Board finds it necessary and desirable that the Sheriff's Office applicant fingerprinting fee be increased to a countywide standard of $18 per person.

 

SECTION 2. DIVISION 2, CHAPTER 2.4, ARTICLE 2.4.50, SECTION 2.4.50.090 of the San Mateo County Ordinance Code is hereby amended, which shall read as follows:

Each individual who applies to have fingerprints scanned and processed by the Sheriff's Office for employment or other non-criminal-proceedings purposes shall pay a fee of $18.00, payable at the time fingerprints are taken, and the Sheriff's Office shall retain said fee to offset the costs of said service.
