RESOLUTION WAIVING THE REQUEST FOR PROPOSAL PROCESS (RFP) AND AUTHORIZING THE EXECUTION OF THE TENTH AMENDMENT TO THE AGREEMENT WITH CALIFORNIA CHECK CASHING STORES, INC.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on December 17, 1991, the County of San Mateo and Monetary Management Corp. entered into an agreement for the issuance of food stamps, which agreement has been amended on nine previous occasions, including extension of the contract term, increase of the "per transaction fee," corresponding increases in the contract maximum obligation, and assignment to different businesses, most recently California Check Cashing Stores, Inc., and

 

WHEREAS, the Ninth Amendment increased the "per transaction fee", but inadvertently reflected the total amount that the Agreement was to be increased, and;

 

WHEREAS, it is being requested that the Board of Supervisors waive the RFP process as the Welfare Reform Act of 1996 mandates that all States convert to the Electronic Benefits Transfer issuance for the Food Stamp Program by February 2003, and; as a result of EBT, check cashing services are being phased out, and

 

WHEREAS, the parties now wish to further amend the Agreement to correct the maximum amount and extend the term of the agreement, and

 

WHEREAS, this Board has been presented with a form of such Amendment to the Agreement and said Board having examined and approved the amendment as to form and content, and desires to enter into the amended agreement;

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and he is hereby, authorized and directed to execute the Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest his signature thereto.
