Resolution Authorizing Execution of a Construction and Maintenance Agreement between the San Mateo County Flood Control District and the Peninsula Corridor Joint Powers Board to Share the Costs of Constructing Flood Control Improvements and a Railroad Bridge over Colma Creek - South San Francisco Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing Board of the San Mateo County Flood Control District, that

WHEREAS, the San Mateo County Flood Control District (District) entered into a cooperative agreement with the Peninsula Corridor Joint Powers Board (JPB) to determine design details for developing equitable, joint funding obligations by participating parties to both widen Colma Creek to flood control design standards and to reconstruct the JPB railroad bridge crossing (PROJECT); and

WHEREAS, plans and specifications for PROJECT have been completed, bids have been solicited and received and an estimate of the costs based on bid prices has been determined; and

WHEREAS, District and JPB have negotiated a Construction and Maintenance Agreement setting terms and conditions for sharing the costs of construction of PROJECT and allocating operation and maintenance responsibilities thereafter; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Construction and Maintenance Agreement whereby District and JPB agree to the funding of PROJECT construction and subsequent operation and maintenance responsibilities, and this Board has examined and considered same as to both form and content and desires to enter into same:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board be, and is hereby, authorized to execute said Construction and Maintenance Agreement on and in behalf of the San Mateo County Flood Control District and the Clerk of the Board of Supervisors of this County be, and is hereby, authorized to attest to the signature of the President thereto and affix the corporate seal of the County of San Mateo.
