Amendment to Agreement for Treatment and Disposal of Sewage from the Town of Woodside's Town Center Sewer Assessment District by and between the Fair Oaks Sewer Maintenance District, the City of Redwood City and the Town of Woodside

Amendment No. 1 made and entered into this ___________ day of ________________________, 2002, by and between the FAIR OAKS SEWER MAINTENANCE DISTRICT, a sewer maintenance district, hereinafter called "FOSMD", the City of Redwood City, a municipal corporation, hereinafter called "Redwood City", and the TOWN OF WOODSIDE, a municipal corporation, hereinafter called "Woodside";

W I T N E S S E T H:

WHEREAS, the properties at 179 Albion Avenue and 239 Miramontes Road in Woodside have failing septic systems and present a potential public health problem; and

WHEREAS, the Woodside Town Council has granted sewer allocations to these properties and authorized their annexation to the TCSAD; and

WHEREAS, it is necessary and desirable to amend the agreements approved by the Board of Supervisors on August 7, 2001 which agreements provide for the Transmission, Treatment and Disposal of Sewage from the TCSAD.

NOW THEREFORE, the Agreement dated August 7, 2001 between the FOSMD, Redwood City and Woodside for the transmission of sanitary sewage from Woodside's Town Center Sewer Assessment District (TCSAD) through FOSMD's facilities, to facilities operated by Redwood City is hereby amended as follows:

"Exhibit A - Town Center Sewer Assessment District Map" referenced in said agreement dated August 7, 2001 is hereby replaced with the attached "Exhibit A" which includes the properties located at 179 Albion Avenue and 239 Miramontes Road, Woodside, in the TCSAD.

IN WITNESS WHEREOF, the parties have hereto caused these presents to be executed by their officers "hereunto duly authorized and have caused their official seals to be affixed hereto all on the day and year first herein above written.
