Resolution Authorizing Execution of the Second Amendment to the Agreement Between the County of San Mateo and Browning-Ferris Industries of California, Inc. for Landfill Operation - Ox Mountain Landfill

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, that certain agreement entitled, Agreement Between County of San Mateo and Browning-Ferris Industries of California, Inc. for Landfill Operation was approved by the County of San Mateo on August 17, 1999, and was effective September 1, 1999, and

WHEREAS, said Agreement specifies that adjustments to Landfill Rates may be made for changes in law or changes in program costs; and

WHEREAS, the California Integrated Waste Management Board has increased the Integrated Waste Management Fee from $1.34 per ton to $l.40 per ton, and the program cost of collecting television and computer monitors at the Ox Mountain Landfill for recycling has increased; and

WHEREAS, an amendment to said Agreement accommodating said allowable pass-through costs through rate increases to the affected categories of waste and recyclable materials received at the Ox Mountain Landfill has been prepared and this Board has reviewed said amendment and finds it necessary and desirable that these rate adjustments be reflected in the Landfill Rate Schedule for the Ox Mountain Landfill.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute the Second Amendment to the Agreement Between County of San Mateo and Browning-Ferris Industries of California, Inc. for Landfill Operation for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest to the President's signature thereto.
