Resolution Authorizing Execution of an Agreement to Allow a Cobblestone Swale and Driveway in Vista Lane - Lands of Denham LLC

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Denham LLC (Denham) is the owner of real property located at 20 Vista Lane, County Road No. 319, located in the Burlingame Hills Area of San Mateo County; and

WHEREAS, Denham has requested the issuance of an encroachment permit to allow a cobblestone swale and driveway approach(encroachments) to remain in the Vista Lane right-of-way adjacent to Denham's property; and

WHEREAS, there has been presented to this Board a form of agreement which provides for said encroachments and which obligates Denham and subsequent owners of the property to maintain, repair, relocate or remove said encroachments at their expense upon demand of County; and

WHEREAS, this Board has considered said agreement.

NOW, THEREFORE, BE IT RESOLVED, that said Agreement by and between the County of San Mateo and Denham LLC is hereby approved, and the President of this Board is hereby authorized to execute said agreement on behalf of the County and the Clerk of this Board shall attest to the President's signature thereto.
