|
1. |
Find that the request is consistent with the County General Plan, the Planned Agricultural/Coastal Development Zoning District, the California Land Conservation Act, and Board of Supervisors Resolution No. 44396, relating to the implementation of the California Land Conservation Act in San Mateo County. |

Adopt a resolution to establish the subject property as an agricultural preserve and authorize execution of a California Land Conservation Contract regarding the subject property. |

Setting: The project site is located in the San Gregorio area of the County and is accessed from Lobitos Creek Road which extends three miles northeast of Highway 1. The topography is generally steep, characterized by a 35% average slope rising from Tunitas Creek Road to a small ridgetop area where a single-family residence is located. There are no prime soils on the property. |

On June 25, 2002, the Planning Commission recommended unanimously to the Board of Supervisors, the establishment of Class B Agricultural Preserve for the subject parcel. |

KEY ISSUES |
|

|
The following criteria must be considered prior to the establishment of an agricultural preserve: |

|
|
|
|
|
The proposed agricultural preserve is consistent with the General Plan designation of "Agricultural" on this property. |
|
|
|

Conformance with Agricultural Preserve Requirements |
|
|

Zoning Classification |
|
|
|
|
|
|
|
In order to be included in an agricultural preserve, land must be located in the Resource Management Zoning District or Planned Agricultural District. The subject parcel is zoned Planned Agricultural District/Coastal Development District. |

Minimum Parcel Size |
|
|
|
|
|
|
|
Lands under a Class B Contract must consist of not less than 100 acres, provided that in order to meet the 100-acre requirement, two (2) or more parcels, may be combined if they are contiguous or in common ownership. A preserve may consist of not less than 40 acres if contiguous to an existing Williamson Act Preserve. |

|
|
|
|
|
The project parcel consists of approximately 47.15 acres. However, this property is adjacent to other lands under agricultural preserve contract. The northeastern parcel (APN 066-290-050), which consists of approximately 266.44 acres, was placed under agricultural preserve in 1967 (County File No. AP67-37). |
|

|
|
|
|
If this property were placed into agricultural preserve, this would form a contiguous group of agricultural preserve land greater than 100 acres (see Attachment D). Therefore, this project qualifies for a Type B contract under the contiguous land criteria. |

Land Use |

|
|
|
Lands within an agricultural preserve must be used only for agriculture or open space, or be suitable for agriculture, open space, compatible uses or the growing of forest products. This property is currently developed with a single-family residence and other uses of the property include a garden area and pasture land. The existing uses of the land are not in conflict with permitted uses allowed in the designated Planned Agricultural District/Coastal Development District or permitted uses for lands within an agricultural preserve. |

Conformance with Local Coastal Program |
|
|
|
|
|
|
The establishment of an agricultural preserve does not involve any development and, therefore, is not subject to the Local Coastal Program and does not require the issuance of a Coastal Development Permit. |

VISION ALIGNMENT |
|
The proposal to establish an agricultural preserve keeps the commitment of preserving and providing people access to our natural environment and Goal Number 14: Important natural resources are preserved and enhanced through environmental stewardship. This proposal contributes to this commitment and goal by restricting uses of the property to agricultural, open spaced and other compatible uses. |

FISCAL IMPACT |
|
The County Assessor's Office has calculated that approval of this agricultural preserve application will result in an estimated yearly loss of taxes of $3,882. Of the total estimated yearly loss in taxes to the County, about $47.15 per year ($1.00 per acre for non-prime land) would be replaced by State subvention money designated to assist County implementation of the Williamson Act.
