Resolution Authorizing Execution of an Agreement for the Installation of Pedestrian Bridge and Concrete Sidewalk in the Nevin Way Right-of-Way - Colma Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Housing Authority of the County of San Mateo (Authority) is the owner of real property in the County of San Mateo, State of California, and has requested the issuance of a Building Permit from the County to install a pedestrian bridge partially within the Nevin Way right-of-way; and

WHEREAS, the Authority, with the concurrence of the Director of Public Works, previously constructed a concrete sidewalk within the Nevin Way right-of-way, adjacent to the Authority's property and housing units, to provide access for the occupants of the housing units; and

WHEREAS, the Director of Public Works has determined that the installation of the pedestrian bridge as proposed by the Authority and the concrete sidewalk will not interfere with the public's use of the Nevin Way right-of-way at this time or in the foreseeable future; and

WHEREAS, the Director of Public Works has recommended that the Authority be obligated to maintain, repair, relocate and/or remove said bridge and concrete sidewalk upon notification from County; and

WHEREAS, this Board has considered the recommendation of the Director of Public Works; and

WHEREAS, there has been presented to this Board a form of agreement which obligates the Authority as recommended by the Director of Public Works and this Board has considered said Agreement.

NOW THEREFORE, IT IS HEREBY ordered and determined that:

The Agreement by and between the County of San Mateo and the Authority, which provides for the installation, maintenance, and removal upon demand of the County, of said pedestrian bridge and concrete sidewalk within the public right-of-way of Nevin Way located West of El Camino Real, between El Camino Real and the Colma BART Station, is hereby approved, and the President of this Board of Supervisors is hereby authorized to execute said agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest to the President's signature thereto.

The Director of Public Works shall cause said agreement to be recorded with the County Recorder and any fees associated with said recordation shall be borne by the Authority.
