MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF SAN MATEO AND THE ORGANIZATION OF SHERIFF'S SERGEANTS

 
 

WHEREAS, the term of the current Memorandum of Understanding between the County and the Organization of Sheriff's Sergeants concludes on October 7, 2006 and permits additional negotiation during its term; and

 

WHEREAS, the Organization of Sheriff's Sergeants entered into negotiations and agreement has been reached agreement has been reached as to an additional Memorandum of Understanding;

 

WHERFORE, the parties agree as follows:

 

1. The County agrees to implement the 3% @ 55 retirement benefit consistent with Government Code section 31664.2. If agreement is reached with the Deputy Sheriff's Association (DSA) and the Probation and Detention Association (PDA) on this change by November 8, 2002, the effective date of the implementation will be January 1, 2003. If such agreement is reached with the DSA and PDA after November 8, 2002, the 3% @ 55 enhancement will be implemented for the fourth pay period after such agreement is reached.

2. The County and the OSS agree to jointly support enabling legislation to allow retirement benefit changes to be implemented by individual bargaining units. Notwithstanding paragraph 1, if such legislation is enacted, the 3% @ 55 enhancement will be implemented the fourth pay period after the legislation is enacted or retroactively to January 1, 2003 if permitted by the legislation.

3. The County agrees to implement the 3% @ 50 retirement benefit consistent with Government Code section 31664.1 effective January 1, 2005. This change is contingent on agreement with the DSA and PDA as referenced in paragraph 1 above or upon enactment of legislation as referenced in paragraph 2 above.

4. With respect to any benefit enhancement pursuant to this MOU, it is agreed that:

    a. The benefit enhancement under Government Code section 31664.2 shall be applicable only to those safety employees who retire after the County's implementation of section 31664.2. The benefit enhancement under Government Code section 31664.1 shall be applicable only to those safety employees who retire after the County's implementation of section 31664.1.

    b. The enhancement will apply to all future safety service and all safety service back to the date of employment pursuant to the Board of Supervisor's authority under to Government Code section 31678.2 (a).

    c. Government Code section 31678.2(b) authorizes the collection, from employees, of all or part of the contributions by a member or employer or both, that would have been required if either section 31664.1 or 31664.2 had been in effect during the time period specified in the resolution adopting either section 31664.1 or 31664.2, and that the time period specified in the resolution will be all future and past safety service back to the date of employment. Based upon this understanding and agreement, and independent of the provisions of paragraph 19.1 of the Memorandum of Understanding effective until October 7, 2006, the OSS agrees that all represented employees will share in the cost of the enhanced retirement benefits as follows:

 

· 2% of salary effective the first pay period in January, 2003.

· An additional 1% (3% total) of salary effective the first pay period in January, 2004.

· An additional 2% (5% total) of salary effective upon the implementation of the 3% @ 50 retirement benefit.

· The manner in which the employee share in the cost of the enhanced benefit is paid (e.g. payroll deduction or increased contribution rates) will be determined by the parties.

· Should an agreement be reached on retirement benefit enhancements with the DSA that results in a lower payment amount for employees, this agreement with the OSS will be modified to reflect this lower cost sharing arrangement.

5. The OSS and the County agree to forego any other re-openers for 2002. The County agrees to engage in discussions with OSS regarding improvements to the County's contributions toward retiree health coverage. These discussions will occur no later than December 15, 2002.

6. The OSS agrees that the current salary will not be increased until January, 2003, unless the DSA receives both an additional salary increase in 2002 and the same retirement improvement at the same time as the OSS.
