Summary Vacation of a Portion of "C" Street near the Daly City BART Station and the Town of Colma in Unincorporated San Mateo County

 

Recommendation
That the Board of Supervisors adopt a Resolution ordering the summary vacation of the portion of "C" Street that lies west of El Camino Real near the Town of Colma, which street is located in Unincorporated San Mateo County.

 

Background
As part of the acquisition for the Daly City BART Station and right-of-way, SamTrans acquired real property adjacent to the station that is surplus to the requirements of the Station and the right-of-way. SamTrans has solicited proposals to develop the surplus property as transit-oriented housing with a minor ancillary commercial element. A portion of the "C" Street right-of-way bisects the proposed development site. This portion of "C" Street, comprised of approximately 30,000 square feet, has never been improved.

 

Discussion

The California Streets and Highways Code allows for a legislative body of a local agency to summarily vacate a street if, for a period of five consecutive years the street or highway is impassable to vehicular traffic or if no public money was used to maintain the street during such period.

There has been no vehicular travel over this portion of "C" Street in the past five (5) years nor has there been any money expended for maintenance during this period. Therefore, in accordance with California Streets and Highways Code, the County is authorized to proceed with a summary vacation.

The Department of Public Works concurs in this recommendation and the Planning Commission has determined that the vacation is in conformity with the General Plan. Processing and consideration of the petition includes notifying public utility companies and local agencies and there were no objections to the proposed vacation. County Counsel has reviewed and approved the resolution as to form.

 

Vision Alignment
The summary vacation keeps the commitment of responsive, effective and collaborative government and goal number 22. County and local governments effectively communicate, collaborate and develop strategic approaches to issues affecting the entire County. The vacation contributes to this commitment and goal since it will aid in the development of more housing.

 

Fiscal Impact
The County is not entitled to compensation for the real property interest that it holds in this street right-of-way.
