RESOLUTION AND ORDER OF SUMMARY VACATION OF A PORTION OF "C" STREET IN UNINCOPORATED SAN MATEO COUNTY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to Streets and Highways Code Division 9, Part 3, Chapter 4, Section 8331, the Board of Supervisors may summarily vacate any portion of a street or highway that for a period of five consecutive years has been impassable for vehicular travel, and upon which no public money has been expended for maintenance on the street or highway during such period, and

 

WHEREAS, that certain portion of C Street as shown on "MAP OF CITY EXTENSION HOMESTEAD ASSOCIATION" recorded in original Map Book D, at Page 44, a copy filed in Book 1 of Maps at Page 13, San Mateo County Records, lying between the westerly line of El Camino Real (shown as County Road on said map) and the northeasterly line of Lands of San Francisco BART District (shown as S.F. and S.J. R.R. on said map) (herein the "Street Area") has for a period of five consecutive years been impassable for vehicular travel.

 

WHEREAS, no pubic money has been expanded for maintenance on the Street Area for five consecutive years; and

 

WHEREAS, the vacation of the Street Area will facilitate the creation of transit-oriented housing: and

 

WHEREAS, the San Mateo County Planning Commission, on January 23, 2002, found the vacation of the Street Area is in conformity with the General Plan of the County of San Mateo (PLN 2001-00813).

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED AS FOLLOWS:

    1. This Board of Supervisors finds that the Street Area is unnecessary for street purposes; and

    2. This Board of Supervisors finds that it is in the public interest to vacate the Street Area; and

    3. Pursuant to Streets and Highways Code Division 9, Part 3,

    Chapter 4, Section 8330 et seq., the Street Area is ordered summarily vacated; and

    4. The Clerk of this Board shall cause a certified copy of this

    Resolution and Order, attested under the seal of this Board, to be recorded in the Office of the County Recorder, and from and after the date so recorded, the above-described Street area shall be vacated and no longer constitute a street, highway, or public service easement; and

    5. The Assistant County Manager is hereby authorized and directed, for and on behalf of the County of San Mateo, to execute such documents, deeds, escrow instructions and agreements as may be required to implement the intent of this Resolution.
