Resolution Authorizing an Increase in Aggregate Payments to the Contractor for the Recontouring of Upper Gazos Creek Road - County Road No. 60B - Pescadero Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board, on June 5, 2001, adopted Resolution No. 064509, which resolution authorized the Director of Public Works to execute an agreement with the State of California Department of Fish and Game for a Fishery Restoration Grant to perform recontouring work along Upper Gazos Creek Road; and

WHEREAS, this Board, on September 17, 2002, adopted Resolution No. 065568, which resolution awarded the contract for the Recontouring of Upper Gazos Creek Road to Conley Construction; and

WHEREAS, sufficient funds are available through the Fishery Restoration Grant to partially finance additional recontouring work along Upper Gazos Creek Road to further reduce erosion along the road; and

WHEREAS, the Director of Public Works has recommended that the "Not-to-Exceed" figure as originally approved by this Board be increased to provide for additional recontouring work; and

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

NOW THEREFORE IT IS HEREBY DETERMINED AND ORDERED that:

1.

The Agreement is hereby amended to provide that aggregate payments to Conley Construction, for said work shall not exceed the sum of One Hundred and Forty-Seven Thousand Dollars ($147,000) without this Board's approval.

2.

The work to be accomplished shall be done as weather permits and shall be completed no later than April 30, 2003

3.

That, with exception of modifications as herein provided, the Agreement with Conley Construction, as authorized by Resolution No. 065568 shall remain unchanged.
