SUBJECT:

Resolution accepting the Certificate of the Chief Elections Officer as the Statement of the Result of the Vote as determined by the official canvass of the returns for the November 5, 2002, Consolidated Gubernatorial General Election, declaring persons elected to certain offices, and accepting the Certificate declaring the person or persons be appointed to certain offices in lieu of holding an election.

 

Recommendation

Adopt a resolution accepting the Certificate of the Chief Elections Officer as the
Statement of the Result of the Vote as determined by the official canvass of the returns of the November 5, 2002 Consolidated Gubernatorial General Election,
declaring the persons elected to certain offices in accordance with Elections Code §8203, and accepting the Certificate declaring the person or persons who have filed Declarations of Candidacy be appointed to certain offices in lieu of holding an election in accordance with Elections Code §10515.

 

Background

California Elections Code §§10411, and 15300 et seq. authorizes and directs the Board of Supervisors and the Chief Elections Officer, within 28 days of an election within the jurisdiction, to inspect, process, and count all ballots and prepare a certified statement of the result, and to deliver a duplicate of that statement to the Secretary of State and to the chairperson of the county central committee of each political party. Upon acceptance of that statement, Elections Code §15400 authorizes and directs the governing body of the jurisdiction to declare elected or nominated the persons having the highest number of votes for the offices voted on and to declare the results of the election as to each measure voted on.

 

Discussion

On November 5, 2002, the Chief Elections Officer conducted a Consolidated Gubernatorial General Election. The official canvass and an abstract or Statement of Votes polled was completed and certified by the Chief Elections Officer on November 26, 2002. This abstract is available at the Office of the Chief Elections Officer, Registration-Elections Division.

This resolution has been reviewed and approved by County Counsel.
