Second Amendment to Agreement For Acquisition of Real Property by the City of Half Moon Bay

 

Recommendation
Adopt a resolution authorizing the President of the Board of Supervisors to execute a Second Amendment to Agreement for Acquisition of Real Property to allow the City of Half Moon Bay to construct improvements on a portion of the Coastside Trail on County-owned property between Metzgar and Seymour in Half Moon Bay.

 

Background
Under the terms of the Agreement For Acquisition Of Real Property dated January 30, 1996 ("Agreement), the County transferred approximately 45 acres ("Property") of the 72 acre Poplar Beach Park to the City of Half Moon Bay ("City"). The Agreement was amended in July, 1999 (Resolution No. 62870) to transfer an additional area of approximately 3 acres to the City.


In the Agreement, the City agrees to use the Property for a recreational and regional park and open space, and to construct and maintain certain improvements for such uses. City also agrees that it will not, without prior written approval of the County, make improvements to the Property that are not included in the Park Master Plan, which was incorporated in the Agreement. The Agreement also required the City to maintain the unimproved section of the Coastside Trail that crosses County property.

 

Discussion
The proposed Second Amendment clarifies the intent of Section 8 (b)(ii) of the Agreement, to confirm that City's obligation to "maintain operate and assume all responsibility for the condition of the unpaved public bluff top trail" over what is described as the "Dumpsite" includes the right to improve that portion of the trail as part of the Coastside Multi-Use Trail.

The City has received grant funds to construct this section of the trail.

Vision Alignment
The Second Amendment To Agreement for Acquisition of Real Property keeps the commitment to preserve and provide people access to our natural environment and goal number 15: Residents have nearby access to green space, such as parks and recreational opportunities. The Second Amendment contributes to this commitment and goal by providing improvements to the coastside trail to increase the public's use and enjoyment.

 

Fiscal Impact
There is no cost to the County in connection with the proposed Second Amendment.
