RESOLUTION AUTHORIZING A SECOND AMENDMENT
TO AGREEMENT FOR ACQUISITION OF REAL PROPERTY
BY THE CITY OF HALF MOON BAY
OF COUNTY PARK PROPERTY KNOWN AS
POPLAR BEACH PARK

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, in 1996 the Board of Supervisors transferred approximately 45 acres of the 72 acre County Park property known as Poplar Beach Park to the City of Half Moon Bay pursuant to an Agreement for Acquisition of Real Property dated January 30, 1996 (the "Agreement"); and

 

WHEREAS, on July 15, 1999, by Resolution Number 62870, the Board of Supervisors authorized and ordered an Amendment to the Agreement to include in the property to be transferred an additional area of approximately three acres known as the South of Poplar Beach Parking Area; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Second Amendment, reference to which is hereby made for further particulars, whereby the County of San Mateo and the City of Half Moon Bay ("City") agree that the City is authorized to construct and maintain trail improvements on the subject real property in accordance with the terms and conditions contained in the Agreement; and

 

WHEREAS, this Board has been presented with a form of such Second Amendment and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

1. That the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Second Amendment for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto; and

2. That the Assistant County Manager is hereby authorized to accept or execute on behalf of the County, any and all notices and documents in connection with this Second Amendment.
