Resolution Authorizing an Increase in Aggregate Payments to the Contractor for El Camino Real Box Culvert Project - Colma Creek Flood Control Zone (FC902 F-149[9U])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing board of the San Mateo County Flood Control District, that

WHEREAS, this Board if Supervisors, on behalf of the San Mateo Count Flood Control District, did, on August 21, 2001, adopt Resolution No. 64713, awarding and authorizing execution of a contract with Homer J. Olsen, Inc for the El Camino Box Culvert Project - Colma Creek Flood Control Zone; and

WHEREAS, the County did enter into an Agreement with Homer J. Olsen, Inc as authorized by said Resolution; and

WHEREAS, the Agreement provides that aggregate payments to Homer J. Olsen, Inc. shall not exceed $10,500,000 without this Board's approval; and

WHEREAS, it is anticipated that the changes in the project will increase the overall contract cost to an amount greater than was originally authorized by this Board; and

WHEREAS, the Director of Public Works had recommended that the not to exceed figure as originally approved by this Board be increased to provide for unanticipated work; and

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

1.

The Agreement is hereby amended to provide that aggregate payments to Homer J. Olsen, Inc. for said work shall not exceed the sum of Ten Million Eight Hundred Thousand Dollars ($10,800,000) without this Board's approval.

2.

That, with exception of modification as herein provided, the Agreement with Homer J. Olsen, Inc entered into on August , 2001, shall remain unchanged.
