First Amendment To Lease Concession Agreement with Patricia Holmes for the Operation of a Stable at Wunderlich Park (Lease No. 5011)

 

Recommendation

Adopt a resolution authorizing the President of the Board of Supervisors to execute a First Amendment To Lease Concession Agreement with Patricia Holmes to amend the lease including an extension of the term.

 

Background

Patricia Holmes has leased the stable complex at Wunderlich Park since 1977. The complex includes a riding ring, a barn, a portable stable structure, the main stable and office. The current agreement is scheduled to expire on April 30, 2003. Ms. Holmes has requested that the County extend the term of the agreement. The Parks and Recreation Division is in the process of developing a master plan for management of the Park, and the extended term accommodates the schedule for completion of that process.

 

Discussion

The proposed First Amendment To Lease Concession extends the term of the agreement through April 30, 2004 and allows for a periodic tenancy thereafter. Either party may terminate the agreement after December 31, 2003 by giving one hundred twenty days prior written notice.

 

The Director of Parks and Recreation concurs in this recommendation. County Counsel has reviewed and approved the amendment as to form.

 

Vision Alignment

The First Amendment To Lease Concession keeps the commitment of responsive, effective

and collaborative government and goal number 20: Government decisions are based on careful consideration of future impact, rather than temporary relief or gain. The agreement contributes to this commitment and goal by accommodating the long-range planning goals of the Parks and Recreation Director while enabling the tenant to continue to provide a service to the public.

 

Fiscal Impact

The monthly rent will continue to be deposited into Parks and Recreation's account.
