RESOLUTION APPROVING AMENDED CONFLICT OF INTEREST CODES FOR VARIOUS SPECIAL DISTRICTS, SCHOOL DISTRICTS, AND COUNTY COMMISSIONS, COUNCILS, AND COMMITTEES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Political Reform Act of 1974 requires every public agency to adopt a Conflict of Interest Code designating employees who must file annual conflict of interest statements;

 

WHEREAS, the Political Reform Act of 1974 further requires that each agency review their Conflict of Interest Code every two years;

 

WHEREAS, public agencies must amend their codes to address changed circumstances such as when new positions have been added or eliminated or the duties of positions have changed; and

 

WHEREAS, each such agency, as listed in Exhibit A, attached hereto, has reviewed its Conflict of Interest Code and has submitted a revised list to the Board for approval.

 

(1.) NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED The Board of Supervisors approves the amended Conflict of Interest Code for each agency listed in Exhibit A of this resolution.

(2.) The terms of 2 Cal. Admin. Code section 18730 and amendments to it duly adopted by the Fair Political Practices commission are hereby incorporated by reference and, along with the list of designated employees and disclosure categories for each agency listed in Exhibit A to this resolution, shall constitute a Conflict of Interest Code.

(3.) Any designated employee who has already filed an annual statement in 2002 is not required to file an initial statement or another annual statement until April 1, 2003.

(4.) Any designated employee who has not filed an annual statement in 2002 shall file an initial statement within 30 days of the date which the County Clerk notifies the agency of the amendment of its code.

(5.) Pursuant to section 18730(b)(4), each designated employee shall file all Statements of Economic Interests with the employee's agency. The agency shall make and retain a copy and forward the original to the County Clerk. The County Clerk shall be the official responsible for receiving and retaining Statements of Economic Interests.

(6.) Each agency head, after consultation with the legal counsel, shall determine which consultants must comply with the disclosure requirements of the agency's Conflict of Interest Code. The agency head shall give written notice to any consultant who is required to file Statements of Economic Interests. No consultant may participate in any decision in which the consultant has a financial interest, whether or not the consultant is required to file Statements of Economic Interests.
