RESOLUTION AUTHORIZING EXECUTION OF A SECOND AMENDMENT TO LEASE AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND DIAMOND AVIATION FOR OFFICE SPACE AT 620 AIRPORT DRIVE AT THE
SAN CARLOS AIRPORT (LEASE NO. 5223)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on November 21, 1995 the County of San Mateo and Diamond Aviation entered into a Lease Agreement as authorized by Resolution Number 59843, as amended on March 21, 2000, by Resolution Number 63484 for office space at 620 Airport Drive at the San Carlos Airport; and

WHEREAS, the parties now wish to amend that agreement; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Second Amendment to Lease Agreement with Diamond Aviation, reference to which is hereby made for further particulars, whereby the County of San Mateo and Diamond Aviation agree to amend the agreement in accordance with the terms and conditions set forth in said Second Amendment To Lease Agreement; and

WHEREAS, this Board has been presented with a form of such agreement and said Board has examined and approved same as to both form and content and desires to enter into same:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED AS FOLLOWS:

1. That the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Second Amendment To Lease Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

2. That the Assistant County Manager is hereby authorized to accept or issue on behalf of the County, any and all notices and documents in connection with the lease as amended by Second Amendment to Lease Agreement and to take such actions as are required to enforce the Lease Agreement as amended including, but not limited to, termination of the Lease Agreement under the terms set forth therein.
