RESOLUTION AUTHORIZING EXECUTION OF A SECOND AMENDMENT TO THE AGREEMENT WITH THE CITY OF SAN MATEO, ITS REDEVELOPMENT AGENCY AND MID-PENINSULA COALITION BELLE HAVEN, AN AGREEMENT WITH SHELTER NETWORK, THE CITY OF SAN MATEO AND MID-PENINSULA COALITION BELLE HAVEN ANDAUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED $25,000 PER FUNDING SOURCE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

    WHEREAS, Shelter Network has applied for funding assistance under the County's CDBG and HOME Programs and from the City of San Mateo's Housing Program for demolition and reconstruction of the First Step for Families facility in San Mateo ("Project"), which, when reconstructed, is expected to consist of 24 emergency shelter units, 15 transitional units, licensed child care space, service and administrative space; and

 

    WHEREAS, County CDBG and HOME funds of $1,251,800 have been set-aside for the Project; and

 

    WHEREAS, the City of San Mateo's CDBG and HOME dollars represent another $500,000 for this Project, the funds which were formally approved on January 6, 2003, by the City of San Mateo City Council; and

 

    WHEREAS, total County and City CDBG and HOME funds equal $1,751,800 for this Project; and

 

    WHEREAS, the land occupied by the First Step project is owned by Mid-Peninsula Coalition Belle Haven, Inc. (a nonprofit affiliate of the Mid-Peninsula Housing Coalition) and has been leased to Shelter Network on a long-term basis to permit it to enter into legal arrangements, including securing financing to construct the facilities, and to operate an emergency and transitional housing facility for homeless families; and

 

    WHEREAS, in 1988 and 1989, the County, the City, and its Redevelopment Agency provided a total of $874,292 to Mid-Peninsula Coalition Belle Haven to assist in property acquisition and conversion of the existing structures on the site to First Step, a homeless shelter; and

 

    WHEREAS, the County, the City and the Redevelopment Agency have negotiated a new 45-year term on the 1988/89 funding to Mid-Peninsula Coalition Belle Haven with a new principal amount or $1,202,700; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, the following: (1) an Agreement with Shelter Network, the City of San Mateo, and Mid-Peninsula Coalition Belle Haven; and (2) a Second Amendment with Mid-Peninsula Coalition Belle Haven, the City of San Mateo, and its Redevelopment Agency; reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

 

NOW THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement and Second Amendment for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

BE IT FURTHER RESOLVED, that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and modifications to this Agreement during the term of the Agreement, provided however, that such authority is limited to (a) reducing or increasing the County's maximum fiscal obligation in the event that there is a commensurate reduction or increase in funding received by the County, provided, however, that such increases shall be limited to a total of $25,000 per funding source; and (b) making changes in the types of services and activities provided by Shelter Network, provided that the changes have no impact on the County's maximum fiscal obligation to the Shelter Network.
