RESOLUTION AUTHORIZING THE SHERIFF TO EXECUTE AGREEMENTS IN CONNECTION WITH THE NORTHERN CALIFORNIA HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) AND RELATED NARCOTICS ERADICATION INITIATIVES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Northern California High Intensity Drug Trafficking Area (HIDTA) is a cooperative law enforcement initiative, created by the federal government in 1997 to combat high intensity drug trafficking; and

 

WHEREAS, HIDTA includes representation and cooperation from the United States Marshall's Office, DEA, FBI and Criminal Investigation Division of the IRS, State Bureau of Narcotics Enforcement and Department of Justice, and local law enforcement agencies; and

 

WHEREAS, HIDTA is a means of implementing state and federal funding for cooperative law enforcement efforts, and therefore has no full time employees, and is staffed by a combination of independent contractors and employees of member law enforcement agencies who are assigned to the HIDTA; and

 

WHEREAS, since the creation of the HIDTA, the San Mateo County Sheriff's Office has served as the fiscal agent and fiduciary for the Northern California HIDTA Executive Committee, in that it receives, deposits and disburses the funding for HIDTA initiatives, and on occasion, the Sheriff has also served as the Chair of the HIDTA Executive Committee; and

 

WHEREAS, this board has previously authorized the Sheriff to execute HIDTA agreements in his capacity as Chair of the HIDTA Executive Committee, and wishes to continue to authorize the Sheriff to execute the agreements in his capacity as fiscal agent and fiduciary for HIDTA funding and other federal and state funding for related narcotics eradication initiatives.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Sheriff or his designee, acting as the fiscal agent for HIDTA as described herein, is hereby authorized and directed to execute Agreements which involve the expenditure of federal and state funding for HIDTA and other related narcotics eradication initiatives for and on behalf of the County of San Mateo. This authority is subject to the HIDTA Executive Committee's direction as to how the funding should be spent, and is subject to the County Counsel's review as to form of the agreements signed by the Sheriff in this capacity.
