RESOLUTION AUTHORIZING EXECUTION OF THE FLAT RATE ALCOHOL AND DRUG TREATMENT AGREEMENT WITH DAYTOP VILLAGE, INC. FOR THE PROVISION OF ALCOHOL AND DRUG TREATMENT SERVICES; AND AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE AMENDMENTS; HOWEVER, SUCH AUTHORITY IS LIMITED TO:

 

A)

REDUCING THE COUNTY'S MAXIMUM FISCAL OBLIGATION IN THE EVENT THERE IS A COMMENSURATE REDUCTION IN THE FUNDING RECEIVED BY THE COUNTY;

 

B)

INCREASING THE COUNTY'S MAXIMUM FISCAL OBLIGATION IN THE EVENT THERE IS A COMMENSURATE INCREASE IN THE FUNDING RECEIVED BY THE COUNTY; HOWEVER, SAID INCREASE SHALL BE LIMITED TO A TOTAL OF $25,000; AND/OR

 

C)

MAKING CHANGES IN THE TYPES OF TREATMENT SERVICES PROVIDED BY CONTRACTOR AS LONG AS THE CHANGES HAVE NO IMPACT ON THE COUNTY'S MAXIMUM FISCAL OBLIGATION.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an agreement reference to which is hereby made for further particulars, whereby Daytop Village Inc. will provide alcohol and drug treatment services; and

 

WHEREAS, this Board has been presented with a form of this agreement and has examined and approved it as to both form and content and desires to enter into this agreement.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED, that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

 

BE IT FURTHER RESOLVED, that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and minor modifications thereto during the initial term of this agreement; however, such authority is limited to:

 
 

a)

reducing the County's maximum fiscal obligation in the event there is a commensurate reduction in the funding received by the County;

 

b)

increasing the County's maximum fiscal obligation in the event there is a commensurate increase in the funding received by the County; however, said increase shall be limited to a total of $25,000; and/or

 

c)

making changes in the types of treatment services provided by Contractor, as long as the changes have no impact on the County's maximum fiscal obligation.
