RESOLUTION RATIFYING HALF MOON BAY FIRE PROTECTION DISTRICT ORDINANCE #2002-01 FOR FILING AND DELEGATING THE ENFORCEMENT OF THE ORDINANCE TO THE CHIEF OF THE HALF MOON BAY FIRE PROTECTION DISTRICT, OR HIS OR HER AUTHORIZED REPRESENTATIVE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Half Moon Bay Fire Prevention District (District) has made certain findings and adopted its Ordinance #2002-01; and,

 

WHEREAS, portions of the District are located within the unincorporated territory of the County, and the District's Ordinance is intended to apply to those portions of the County within the District; and,

 

WHEREAS, Health and Safety Code section 13869.7 requires a fire protection district to adopt building standards relating to fire and public safety that are more stringent than the building standards adopted by the State Fire Marshall; and,

WHEREAS, Health and Safety Code section 13869.7 requires a fire protection district to transmit the district's adopted fire protection ordinance to the legislative body of the county wherein the ordinance will apply, for ratification, modification, or denial; and

WHEREAS, the Board of Supervisors is the legislative body for the County of San Mateo.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that this Board ratify the Ordinance and that within 15 days this ratification be transmitted to the Half Moon Bay Fire Prevention District; and

IT IS HEREBY FURTHER DETERMINED AND ORDERED that a copy of the findings of the District together with the Ordinance be filed with the California Department of Housing and Community Development; and

IT IS HEREBY FURTHER DETERMINED AND ORDERED that the Chief of the Half Moon Bay Fire Protection District, or his or her authorized representative, is hereby delegated with the enforcement of this Ordinance.
