Resolution Authorizing an Increase in Aggregate Payments to the Contractor for the Reconstruction of Portions of Paloma, San Carlos, Escalona, Navarra, Ferdinand and
San Juan Avenues

(Projects No. R6F00, R6G00 and R6H00 - F-36 [231]) El Granada Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on March 26, 2002, adopt Resolution No. 65149, awarding and authorizing execution of an agreement with McGuire & Hester for the Reconstruction of Portions of Paloma, San Carlos, Escalona, Navarra, Ferdinand and San Juan Avenues in the El Granada Area (El Granada Roadway and Drainage Improvement Project); and

WHEREAS, the County entered into an Agreement with McGuire & Hester, as authorized by said resolution; and

WHEREAS, the agreement provides that aggregate payments to McGuire & Hester shall not exceed $1,270,000 without this Board's approval; and

WHEREAS, it is anticipated that changes in the project will increase the overall contract cost to an amount greater than was originally authorized by this Board; and

WHEREAS, the Director of Public Works has recommended that the not-to-exceed figure as originally approved by this Board be increased to provide for unanticipated work; and

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

1.

The Agreement is hereby amended to provide that aggregate payments to McGuire & Hester for said work shall not exceed the sum of One Million Three Hundred Seventy-Two Thousand Five Hundred and No/100 Dollars ($1,372,500.00) without this Board's approval.

2.

That, with exception of modification as herein provided, the Agreement with McGuire & Hester, entered into on March 26, 2002 shall remain unchanged.
