Resolution Authorizing Acceptance of an Offer to Dedicate a Conservation Easement and a Conservation Easement Grant from the Wicklow Estate to the County of San Mateo; and authorizing execution of all necessary documents related thereto

 

Recommendation

Adopt a resolution authorizing acceptance of the Offer to Dedicate and the Conservation Easement Grant from the Wicklow Estate and execution of all necessary documents related thereto.

 

Background

On December 19, 2002, the San Mateo County Zoning Hearing Officer approved an application by the Peninsula Open Space Trust (POST) for a coastal development permit, planned agricultural permit and lot line adjustment to adjust the boundary line of two parcels located in unincorporated El Granada. At the time the original parcels in question were owned by ETOP Properties and the Wicklow Estate. POST was in the process of completing its acquisition of the ETOP parcel, and the Wicklow Estate had offered to donate a significant portion of its original parcel to POST as well. The lot line adjustment was necessary to facilitate these transfers.

 

Discussion

As originally proposed, the lot line adjustment would leave a 21 acre parcel owned by the Wicklow Estate with an existing single family dwelling. Requirements under the Planned Agricultural zoning district require that non-agricultural parcels shall be as small as possible, not to exceed five acres in size. In order to address this limitation under the circumstances presented, our office recommended a condition requiring a conservation easement that would limit any future non-agricultural or open space development to a five acre area. The property owner was agreeable to this condition, and has now presented an offer to dedicate and a grant of a conservation easement in accordance with the Condition of Approval. Our office has reviewed and approved the form of offer and grant.
