Recommendation |
Adopt a Resolution authorizing the President of the Board of Supervisors to execute an agreement to exchange sanitary sewer easements of equal value with Frederick L. Herring, Trustee of the William Dwight Duthie 1987 Trust, execute a Quitclaim Deed and execute the Certificate of Acceptance for the Easement Grant Deed. |

Background |
In 1986, the County acquired a sanitary sewer easement on property located on Oak Knoll Drive in Emerald Lake Hills for the Emerald Lake Hills Sewer Maintenance District.
The current sewer facilities are not located within the current easement. The exchange of easements will allow for an easement over the area where the actual sewer line was constructed. |

Discussion |
An agreement has been negotiated with Frederick Herring to exchange easements. The easements are considered to be of equal value. |

State statutes require that a notice of an intended exchange of property interests be published
once in a newspaper of general circulation. The notice has been published. |

The exchange agreement presented for your approval provides for the County to Quitclaim to Frederick Herring, Trustee of the William Dwight Duthie 1987 Trust the easement not required by the County in exchange for an Easement Grant Deed for the easement that is needed by the County. |

The Director of Public Works concurs with our recommendation. County Counsel has reviewed and approved the agreement as to form. |
