RESOLUTION IN SUPPORT OF SENATE BILL 1025 (ESCUTIA) REGARDING ACCESSIBILITY IN NEWLY CONSTRUCTED MULTILEVEL TOWNHOUSES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Fair Housing and Employment Act prohibits discrimination including the failure to design and construct multifamily dwellings in a manner that allows access to, and use by, disabled persons by providing a minimum of accessibility features, if the building has an elevator, and by requiring that all ground floor units in buildings without elevators provide the accessibility features; and

WHEREAS, the Fair Housing and Employment Act contains a loophole that permits developers to construct multilevel townhouses without accessibility features in buildings with neither elevators nor ground floor units; and

 

WHEREAS, Senate Bill 1025 by Senator Escutia would require that newly constructed multilevel townhouses without elevators include at least one unit that has access for mobility impaired persons to the primary level floor and an accessible bathroom on that same level.

 

WHEREAS, support of Senate Bill 1025 furthers the County's Visioning 2010 commitment to offer a full range of housing choices and supports Visioning Goal #9 to ensure that housing exists for people at all income levels and for all generations; and

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the San Mateo County Board of Supervisors by the adoption of this resolution hereby supports Senate Bill 1025 (Escutia) regarding accessibility in newly constructed multilevel townhouses.
